1. Acceptance
These Terms are an agreement between you and Robertson Software LLC ("Robertson Software," "we," "us," "our") for your use of our applications and related services, including Goalito (web, iOS, and Android) (together, the "Service"). By creating an account or using the Service you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
2. Eligibility and age
You must be at least 13 (or a higher local minimum). If you are under the age of majority where you live, you confirm a parent or guardian permits your use. You represent that you can form a binding contract.
3. Your account
Keep your credentials secure; you are responsible for activity under your account. Provide accurate information, and tell us promptly at [email protected] of suspected unauthorized use. Robertson Software operates one identity across its apps; the same account may access other Robertson Software apps, each subject to its own terms where applicable.
4. Acceptable use
Use the Service for your own personal purposes or your own internal business purposes. Don't: break the law or infringe others' rights; access data that isn't yours or probe or breach security (no unauthorized access, scraping, reverse engineering except as law permits, or circumventing controls); disrupt or overload the Service; upload malware or unlawful, harmful, or abusive content; or resell, sublicense, or commercially exploit the Service itself without permission. Notes you keep about other people are personal notes for your own use; be respectful and lawful about information you record about others.
5. Subscriptions and billing
The Service may offer paid plans. Web purchases are sold by Paddle, our merchant of record; mobile purchases are sold by the Apple App Store or Google Play (each the merchant of record for purchases made through them), and are also subject to that store's or Paddle's terms.
- Trials: paid plans may start with a free trial; the length is shown at signup (currently 14 days for Goalito). Cancel during the trial and you pay nothing.
- Renewals: subscriptions auto-renew for the same period until cancelled. Cancel anytime; cancelling stops the next renewal and your access continues to the end of the current period.
- Cancellation and refunds: manage and cancel through the channel you purchased from; refunds are described in our Refund Policy and are handled by the merchant of record, plus non-waivable local rights (for example EEA/UK withdrawal rights).
- Lapse: if a renewal payment fails or your subscription lapses, your account becomes read-only; your data is retained per the Privacy Policy, and full access returns when you resubscribe.
- Price changes: we may change prices or features with advance notice, effective at your next renewal; cancel before then if you don't agree.
- Taxes: prices may exclude taxes that the merchant of record adds as required.
- Lifetime purchases: a "lifetime" purchase grants access for as long as we offer the app it was purchased for (the lifetime of the product, not of the purchaser), with the wind-down protections in section 10.
6. Intellectual property (ours)
The Service, its software, design, branding, the "Goalito" and "Robertson Software" names and logos, and our content belong to Robertson Software and its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service per these Terms; all other rights are reserved. Don't use our names or logos without permission. The software license for our apps, including store-specific terms, is detailed in our End User License Agreement.
7. Your content
You own your content. To run the Service we need a limited, worldwide, non-exclusive, royalty-free license to host, store, back up, process, transmit, and display your content solely to operate, secure, support, and improve the Service for you. That license ends when you delete the content or your account, except for residual backup copies kept for a limited period and records we must keep by law. We do not use your private content for advertising or to train AI models. You are responsible for your content and confirm you have the right to store it.
8. Disclaimers ("as is")
The Service is provided "as is" and "as available," without warranties of any kind to the maximum extent permitted by law (including merchantability, fitness for a particular purpose, and non-infringement). We do not warrant that it will be uninterrupted or error-free, or that data will not be lost; keep your own copies of anything you cannot afford to lose. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Beta features. We sometimes ship features labeled beta, preview, or experimental. They may change, break, or be withdrawn at any time and carry the same disclaimers as the rest of the Service.
Not professional advice. The Service is a general goal, habit, and relationship tracker for personal and informational use only. It does not provide professional advice of any kind, including medical, mental health, financial, investment, legal, or tax advice, and nothing in it (including templates and guides) is a substitute for a qualified professional. Consult a licensed professional before making decisions about your health, finances, legal matters, or taxes.
Not for emergencies. If you are in crisis or thinking about harming yourself, or someone is in danger, contact your local emergency services or a crisis line right away. The Service cannot help in an emergency.
Your data is what you enter. The Service shows back the information you record, such as goals, streaks, and targets. It does not verify that information and cannot guarantee any result.
9. Limitation of liability
To the maximum extent permitted by law, Robertson Software and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, or goodwill. Our total aggregate liability for any claim will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD $100. Nothing in these Terms limits liability that cannot be limited by law (for example certain EEA/UK consumer rights).
10. Termination
You can stop using the Service and delete your account anytime in the app; deletion removes your content per the Privacy Policy. We may suspend or terminate access for breach, unlawful or harmful use, or as required by law, with notice where reasonable and lawful. We may also suspend accounts that abuse the billing process (for example, repeated chargebacks on charges you authorized). Ownership, disclaimers, liability limits, and governing law survive termination.
Discontinuation. We may discontinue the Service, or an individual app, with at least 30 days' advance notice (in-app and/or by email). If we do, we will: stop renewals so you are not charged for any period beyond the shutdown date; refund the unused portion of any prepaid subscription period; and, for lifetime purchases, issue a pro-rata refund treating the purchase as covering 36 months of service from the purchase date. Before shutdown you will have at least 30 days to request an export of your content; afterwards data is deleted per the Privacy Policy, except records we must keep by law.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in San Diego County, California, except where applicable consumer law lets you bring claims in your home jurisdiction.
12. General
If part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with the policies they link to, are the entire agreement between us about the Service. We may assign these Terms as part of a merger, acquisition, or sale of assets; you may not assign them without our consent. If we don't enforce a provision right away, we haven't waived it. Neither of us is liable for delay or failure caused by events beyond reasonable control (for example natural disasters, war, or failures of internet infrastructure), except for payment obligations. These Terms are written in English; where we provide translations for convenience, the English version controls, except where the law of your home jurisdiction requires otherwise.
13. Changes
We may update these Terms. For material changes we give notice (in-app and/or by email) and update the "Last updated" date. Continued use after changes take effect means acceptance; otherwise stop using the Service, and you may delete your account.
