1. What this agreement is
This End User License Agreement ("EULA") is between you and Robertson Software LLC ("Robertson Software," "we," "us," "our") and covers the software applications we publish, including Goalito for web, iOS, and Android (each an "App"). It works together with our Terms of Service, which are incorporated by reference and also govern your use of the service behind the App; if this EULA and the Terms conflict about the software license itself, this EULA controls.
If you downloaded an App from the Apple App Store or Google Play, this EULA is between you and Robertson Software only, not with Apple Inc. ("Apple") or Google LLC ("Google"). Robertson Software, not Apple or Google, is solely responsible for the App and its content.
2. Your license
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App for your own personal, non-commercial purposes on devices you own or control, per these terms. For Apps obtained from the Apple App Store, the license is also limited to use on Apple-branded products as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including use by family members via Family Sharing where available). All rights not expressly granted are reserved.
3. What you may not do
Except as permitted by law or by open-source licenses covering included components, you may not copy, modify, distribute, sell, rent, lease, or sublicense the App; reverse engineer, decompile, or attempt to extract its source code; remove proprietary notices; or use the App to build a competing product. Acceptable-use rules for the service are in the Terms of Service.
4. Updates, maintenance, and support
We may provide updates that install automatically or through your device's app store. Robertson Software, not Apple or Google, is solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance and support services for it. 5. Warranty
The App is provided "as is," with the warranty disclaimers set out in the Terms of Service, to the maximum extent permitted by law. For an App obtained from the Apple App Store: in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Robertson Software's responsibility.
6. Claims
Robertson Software, not Apple or Google, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including: (a) product liability claims; (b) any claim that the App fails to conform to an applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. In the event of a third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, Robertson Software, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of the claim.
7. Legal compliance and export
You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms when using the App (for example your wireless carrier's data agreement).
8. Apple as third-party beneficiary
For Apps obtained from the Apple App Store, Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of it, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
9. Termination
This license runs until terminated. It ends automatically if you materially breach it or the Terms of Service, and when you delete your account and remove the App. On termination, stop using and delete the App. Sections that by their nature should survive (ownership, disclaimers, liability limits, governing law) survive.
10. Governing law and everything else
